Can the computer software obtain patent rights

China's patent law doesn’t exclude the computer software out of patent application. However, in most countries computer software is "copyright" or formulated specialized laws specifically to be protected. There also have passed the "Copyright Law" and the "Computer Software Protection Regulations" in China. Therefore, the simple computer software cannot obtain a patent. Only when the software changes follow the changes of computer's hardware, the two  can together apply for invention patents and access to patents to protect its patent rights.
